Red Hat posts good results, gets sued for patent infringement

Something of a good news/bad news day for Red Hat, which announced quarterly revenue up 38% year-on-year, only to find itself served with a patent infringement lawsuit.

The Linux vendor announced revenue of $84.0m for its first quarter of fiscal 2007, up from $60.8m the same time last year. Net income was also up slightly, to $13.5m from $12.6m.

No sooner had they been announced, however, than it emerged that Red Hat faces a patent infringement case filed by a company called FireStar Software. According to Firestar's complaint, Red Hat - and specifically the Hibernate technology it acquired with JBoss - infringe US Patent No 6,101,502, which FireStar applied for in September 1998 and was granted in August 2000.

The patent itself is related to interfacing an object oriented software application with a database. FireStar is looking for a judgment preventing Red Hat from distributing Hibernate, for all infringing materials to be destroyed, and - of course - for damages.

No official response from Red Hat as yet.
